What is a Trademark?
A trademark is any unique sign capable of distinguishing the goods or services of one enterprise from those of others. It can be a word, name, logo, slogan, shape, colour combination, packaging design or any combination of these elements. Under the Trade Marks Act, 1999, a registered trademark gives you the exclusive right to use that mark in connection with your goods or services across India.

Frequently Asked Questions
What is a trademark in India?
A trademark is a unique sign — word, logo, slogan, shape, colour or combination — that distinguishes your goods or services from those of others. Registered under the Trade Marks Act, 1999, it gives you the exclusive right to use the mark for your goods or services across India and the legal power to stop others from using a similar mark.
How long does trademark registration take in India?
Without objections or opposition, trademark registration takes approximately 18–24 months from the date of filing. Your application number is issued within 1–2 working days, and you can use the ™ symbol immediately. The ® symbol is only authorised after the registration certificate is issued.
How many trademark classes are there in India?
India follows the Nice Classification system with 45 classes — 34 for goods (Classes 1–34) and 11 for services (Classes 35–45). Your trademark must be registered in each class relevant to your actual goods and services. See our complete TM Classes guide for the full list.
Can I file a trademark for a logo?
Yes. Logos, device marks, stylised wordmarks and combined marks (word + logo) can all be registered as trademarks in India. A colour logo can be filed in colour — giving protection for that specific colour combination — or in black and white, which provides broader protection regardless of colour. We advise on the best filing strategy for your specific mark.
What is the difference between TM and ® symbol?
The ™ symbol can be used from the date of filing the trademark application — no registration is required. The ® symbol can only be used after the trademark registration certificate is officially issued by the Registrar of Trade Marks. Using the ® symbol before registration is a punishable offence under Section 107 of the Trade Marks Act, 1999.
