A trademark registration is valid for 10 years from the date of the original application. It can be renewed indefinitely — for any number of successive 10-year terms — by filing a renewal application in Form TM-R and paying the prescribed government fee.

When to Apply for Trademark Renewal

Standard Renewal Window

Application can be filed starting 1 year before the expiry date. This is the preferred window — no additional fees, smooth processing.

Grace Period (After Expiry)

6 months after expiry — renewal still permitted but an additional late fee of Rs 5,000 per class is payable along with the standard renewal fee.

Restoration Period

Up to 1 year after expiry — the Registrar may restore the trademark on application with justification and payment of prescribed fees.

After Restoration Deadline

After 1 year from expiry — the trademark cannot be restored in any manner. The mark is permanently removed from the register.
